Landlords are often not clear about what their responsibilities are, some of which are outlined below; we help our clients inform.

FIRE RISK ASSESSMENT

WHY: The Regulatory Reform (Fire Safety) Order 2005 replaces previous legislation and applies to common areas of flats and maisonettes as well as commercial sites. Fire certificates are no longer valid (although the content may continue to be helpful) and fire risk assessments must be undertaken.

Management of Asbestos

WHY: The Control of Asbestos at Work Regulations 2006 requires that asbestos be looked for, recorded and managed in all non-domestic premises (which include common areas of flats and maisonettes). This duty normally falls on those in control of the maintenance and repair of the premises.

Anyone working on a building now needs to be told formally about any asbestos in the building, lest he should disturb it, and suffer long-term injury. 

HSE guidance is published in MDHS 100. If samples are required, they are to be taken by a qualified and experienced person who has passed the P402 ‘Asbestos Surveying and Sampling’ course.

Asbestos is currently the biggest occupational health risk to workers in Britain. About 3,500 people are dying every year as a result of exposure to asbestos many years ago, before it was banned. This figure is expected to reach 10,000 deaths annually, peaking sometime between the years 2011 and 2015. Most of these deaths are from Mesothelioma (cancer of the space around the lungs) or lung cancer.

HEALTH & SAFETY RISK ASSESSMENT

WHY: Risk Assessments have been required by the Management of Health and Safety at Work Regulations since 1992. Common parts of flats and maisonettes are workplaces.

Duty-holders are required to identify risks in workplaces and to reduce those risks as low as is reasonably practical. Risk assessments consider the nature of the hazards, who might be harmed, the likelihood of an occurrence, the likely impact or injury, what precautions are in place and what reasonably practical additional and/or alternative precautions can be put into place to remove or reduce the risk.

There are others, e.g. inspection of fixed electrical equipment and perhaps water testing on some sites. The health and safety surveys / risk assessments will identify what legal requirements are needed and whether they are being met, often establishing legal compliance and that little more is required.
